These Terms and Conditions ("Terms") govern access to and use of the CarryParcels platform, available at carryparcels.com and its associated web and mobile applications (the "Platform"), operated by Abacus Consultancy Services (I) Pvt Ltd ("ACS", "we", "us", or "our"). By accessing the Platform, logging in to an Agent account, or using any CarryParcels service, you ("Agent", "you") agree to be bound by these Terms and our Privacy Policy (together, the "Agreement"). If you do not agree, do not access or use the Platform.
1. About CarryParcels
CarryParcels is a booking platform for rail parcel agents, freight forwarders and similar intermediaries ("Agents") who book parcel and cargo space on Indian Railways passenger trains on behalf of their own clients. Through the Platform an Agent can link with parcel lease holders, manage a roster of clients, search trains, make bookings, track parcels and view the commission recorded on each booking.
CarryParcels is a technology and booking intermediary. It is not Indian Railways and is not operated by any government body. The physical carriage of parcels by rail is performed by the relevant Indian Railways parcel lease holder for the selected train, under their own lease/licence and applicable Indian Railways rules, which CarryParcels does not control.
2. Definitions
- Agent — the business account (agency, freight forwarder, customs house agent, transporter or aggregator) set up on CarryParcels to book rail cargo on behalf of its clients.
- Agent User — an individual staff member added under an Agent account with their own login.
- Buyer — a client of the Agent whose details the Agent adds to the Platform and on whose behalf the Agent makes bookings.
- Consignee — the person or business named as the receiver of a parcel.
- Lease Holder — the Indian Railways parcel space lease/licence holder who accepts, carries and delivers a booking made through CarryParcels.
- Commission — the amount recorded against a booking for the Agent, calculated from the commission rate on the Agent's link with the relevant Lease Holder.
3. Eligibility & Agent Accounts
You register as an Agent through carryparcels.com. We verify your business details (including GST registration where provided) before activating an Agent account, and may decline any registration. You must be at least 18 years old and able to enter into a binding contract under Indian law, and you must be authorised to act for the business you register.
You sign in with your registered mobile number and a 6-digit PIN. You are responsible for the accuracy of your profile information, including GST and bank details, and for keeping your PIN confidential. Never share your PIN; CarryParcels staff will never ask for it. Notify us immediately of any unauthorised use of your account. The Agent is responsible for all activity carried out by Agent Users added under its account.
4. Booking for Your Buyers
When you add a Buyer or Consignee to the Platform or book on their behalf, you confirm that:
- you have their authority to book rail cargo for them and to share their details with us and with the Lease Holder for that purpose;
- the names, phone numbers, GST numbers, addresses and markings you enter are accurate and up to date;
- you have told them that their details will be processed as described in our Privacy Policy, including for booking receipts and status notifications.
Your commercial relationship with your Buyers — including what you charge them, your credit terms and your invoices to them — is between you and your Buyer. CarryParcels is not a party to it.
5. Bookings & Prepayment
Bookings made through the agent portal are prepaid; the base charge, GST and total payable are shown before you confirm. Bookings, weight entries, dimensions and booking slips are based on the information you supply at the time of booking.
Chargeable weight is the higher of actual weight, volumetric weight and any minimum chargeable weight set for the selected train; some trains charge per parcel instead. The Lease Holder or station staff may verify actual weight and count when the parcel is handed in, and the booking may be adjusted or refused if the declared details are wrong.
CarryParcels is not responsible for penalties, delays or disputes arising from inaccurate declared weight or count, incorrect Buyer or Consignee details, or prohibited or undeclared goods. Weight verification, coach capacity and compliance with Indian Railways parcel rules remain the responsibility of the Lease Holder and station staff who accept and carry the parcel.
6. Charges, Commission & Refunds
Freight charges shown at booking are set by the Lease Holder for the selected train and route. CarryParcels is a technology and booking provider and is not itself the carrier for any parcel booked through the Platform. Any payment gateway used on the Platform operates in accordance with applicable Reserve Bank of India (RBI) guidelines, and payment instruments are subject to their issuer's terms.
Each booking shows the Lease Holder's shipping cost, the Agent Commission and the Platform Commission. Commission is calculated from the rate recorded on your link with that Lease Holder at the time of booking. Commission figures shown on your dashboard are for your records and reconciliation; how and when commission is settled is governed by the commercial arrangement between you, the Lease Holder and ACS.
Cancellation and refund eligibility for a booking depends on the Lease Holder's policy for that train and the stage the parcel has reached in its journey.
7. Lease Holder Links
You can only book on trains run by Lease Holders you are linked with. You may connect with a Lease Holder by entering their registered phone number, and you may remove a link at any time. You are responsible for agreeing your commission rate with each Lease Holder and keeping it accurate on the Platform; changes apply to bookings made after the change.
CarryParcels does not guarantee the availability of any Lease Holder, train, route, coach space or rate, and does not endorse any Lease Holder.
8. Roles & Responsibilities
- Agents are responsible for the accuracy of the booking, Buyer and Consignee information entered by them and their Agent Users, for having their Buyers' authority to book, for packing and handover instructions given to their Buyers, and for their Agent Users' conduct on the Platform.
- Lease Holders are responsible for accepting, weighing, loading, carrying, unloading and delivering parcels booked on their trains, in accordance with their own lease/licence with Indian Railways.
- CarryParcels is responsible for operating the Platform with reasonable care and skill.
9. Tracking & Notifications
Every booking has a booking number that anyone holding it can use to view the parcel's status on the public tracking page, without logging in. Share booking numbers only with people who should see that status. Booking receipts, status updates, OTPs and PIN resets may be sent by WhatsApp, SMS or email to the numbers and addresses on the account or booking. Tracking information depends on updates recorded by station staff and may be delayed.
10. Acceptable Use
You agree not to: (a) use the Platform for any unlawful purpose or to book prohibited, hazardous or undeclared goods; (b) make bookings for anyone without their authority, or enter false Buyer, Consignee or weight details; (c) attempt to gain unauthorised access to any account, data or system; (d) reverse-engineer, scrape or interfere with the Platform's normal operation; or (e) upload content that is fraudulent, defamatory or infringes third-party rights. We may suspend or terminate accounts that violate this section.
11. Intellectual Property
The Platform, including its software, design, trademarks and content, is owned by or licensed to ACS and is protected by applicable intellectual property laws. Nothing in these Terms transfers ownership of the Platform to you. You retain ownership of data you upload (such as booking and Buyer records), and you grant us a licence to process it solely to provide the Platform's services to you and to the Lease Holders fulfilling your bookings.
12. Limitation of Liability
To the maximum extent permitted by law, CarryParcels and ACS shall not be liable for any indirect, incidental or consequential damages, including loss of revenue, commission, data or goodwill, arising from use of the Platform. CarryParcels is not liable for loss of, damage to, or delay of any parcel while in the custody of a Lease Holder or Indian Railways. Our aggregate liability for any claim relating to the Platform is limited to the platform commission received by ACS on the affected Agent's bookings in the three (3) months preceding the event giving rise to the claim. Nothing in this section limits liability that cannot be excluded under applicable law.
13. Suspension & Termination
We may suspend or terminate access to the Platform, immediately and without notice, if an account is used in violation of these Terms or applicable law, or if continued provision of the service is disrupted by a third-party provider (for example a payment gateway, hosting, or SMS/WhatsApp provider) for reasons outside our control. An Agent may ask us to close its account at any time. Termination does not affect charges or commission already accrued or bookings already in progress.
14. Force Majeure
We shall not be liable for any delay or failure to perform our obligations under this Agreement resulting from events beyond our reasonable control, including natural disasters, strikes, disruption to Indian Railways operations, internet or telecommunications outages, or governmental action.
15. Changes to These Terms
We may update these Terms from time to time to reflect changes to the Platform or applicable law. Material changes will be notified through the Platform, by WhatsApp or by email. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
16. Governing Law & Dispute Resolution
This Agreement is governed by the laws of India. Any dispute arising out of or in connection with this Agreement shall first be referred to arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Mumbai, Maharashtra. Subject to the foregoing, the courts at Navi Mumbai, Maharashtra shall have exclusive jurisdiction.
